Terms of Service

By accessing or using the Chattr platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and Chattr ("we", "us", "our"), the operator of this Service.

Chattr is a software-as-a-service (SaaS) platform that provides tools for managing OnlyFans creator accounts, including AI-assisted automated messaging, content vault management, workspace collaboration for agencies, and earnings analytics (the "Service").

IMPORTANT DISCLAIMER: Chattr is an independent third-party tool. We are not affiliated with, endorsed by, or in any way officially connected with OnlyFans, Fenix International Limited, or any of their subsidiaries. "OnlyFans" is a registered trademark of Fenix International Limited.

To use the Service, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding contract in your jurisdiction.
• Not be prohibited from using the Service under any applicable law.
• Be either the owner of the OnlyFans account(s) you connect to Chattr, or an authorized representative acting on behalf of the account owner with their explicit written consent.

By using the Service, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate your access if we determine, at our sole discretion, that you do not meet these requirements.

You must register an account to access the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must notify us immediately at legal@chattr.io upon becoming aware of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this obligation.

The Service allows you to connect your OnlyFans account(s) by providing session authentication data ("Credentials"). By providing your Credentials, you:

• Represent that you are the lawful owner of the connected account(s) or an authorized agent.
• Authorize Chattr to access OnlyFans APIs on your behalf solely to provide the Service features you have activated.
• Acknowledge that Chattr stores your Credentials in encrypted form and takes reasonable technical measures to protect them.
• Understand and accept that using third-party automation tools may be subject to restrictions under OnlyFans' Terms of Service, and that Chattr bears no responsibility for any actions taken by OnlyFans against your account, including suspension or termination.
• Accept full responsibility for ensuring your use of Chattr complies with OnlyFans' Terms of Service, Community Guidelines, and any other applicable rules.

You may revoke Chattr's access at any time by removing your connected account(s) from the platform. Upon removal, we will delete your stored Credentials.

The Service includes an AI Chatter feature powered by artificial intelligence that can generate and send messages to your OnlyFans subscribers on your behalf ("AI Messages"). By enabling this feature, you:

• Acknowledge that AI Messages are generated algorithmically and may not always be accurate, appropriate, or aligned with your intended communication.
• Accept full legal and ethical responsibility for all AI Messages sent from your account.
• Represent that you have reviewed and configured the AI behavior in a manner consistent with applicable law and OnlyFans' policies.
• Understand that AI Messages may involve processing conversation history, subscriber messages, and content metadata from your OnlyFans account.
• Agree not to use the AI feature to send illegal content, impersonate real persons, engage in fraud, or violate any applicable law or regulation.

Chattr does not review AI Messages before transmission. We are not responsible for the content, consequences, or subscriber responses resulting from AI Messages.

The Service allows account owners to create workspaces and invite team members with defined roles (Owner, Admin, Chatter, Viewer). You, as the workspace owner, are solely responsible for:

• The actions of any team members you invite to your workspace.
• Ensuring invited members have appropriate authorization and understand these Terms.
• Any breach of these Terms by your team members.

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Send, distribute, or otherwise transmit any content that is illegal, harmful, defamatory, obscene, or otherwise objectionable, beyond what is lawfully permitted under applicable law.
• Engage in any form of harassment, abuse, or exploitation of minors. The Service is strictly prohibited for any content involving persons under 18 years of age.
• Attempt to circumvent, disable, or interfere with security-related features of the Service.
• Use automated scripts to access the Service in a manner that could overload, damage, or impair our infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Resell, sublicense, or otherwise transfer the Service to third parties without our prior written consent.

The Service, including all software, algorithms, designs, text, and documentation, is owned by Chattr and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose during your subscription term.

You retain all rights to the content you upload, configure, or create within the Service. By using the Service, you grant us a limited, royalty-free license to process and store your content solely as necessary to provide the Service.

Access to certain features of the Service requires payment of subscription fees as set out on our pricing page. All fees are stated in US Dollars (USD) and are exclusive of applicable taxes unless stated otherwise. Fees are non-refundable except as required by applicable law or as expressly stated in these Terms.

We reserve the right to modify our fees upon 30 days' prior written notice. Your continued use of the Service after the fee change takes effect constitutes your acceptance of the new fees.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) ANY AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE; (C) THE SERVICE WILL BE COMPATIBLE WITH YOUR ONLYFANS ACCOUNT AT ALL TIMES, GIVEN THAT ONLYFANS MAY CHANGE ITS API OR TERMS WITHOUT NOTICE; OR (D) THE SERVICE WILL RESULT IN ANY PARTICULAR FINANCIAL OUTCOME OR REVENUE INCREASE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CHATTR, ITS DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• YOUR USE OF, OR INABILITY TO USE, THE SERVICE;
• ANY CONTENT TRANSMITTED OR RECEIVED BY YOU THROUGH THE SERVICE;
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR STORED DATA;
• THE SUSPENSION, TERMINATION, OR RESTRICTION OF YOUR ONLYFANS ACCOUNT BY ONLYFANS;
• ANY AI MESSAGE SENT ON YOUR BEHALF.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

You agree to defend, indemnify, and hold harmless Chattr and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) any AI Messages sent through your account; (d) your violation of any third-party rights, including OnlyFans' Terms of Service; or (e) any claim that your content caused damage to a third party.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by deleting your account through the dashboard settings. Upon termination, we will delete your data in accordance with our Privacy Policy, subject to any legal retention obligations.

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the competent courts of Spain.

If you are a consumer resident in the European Union, you may also submit complaints to your local consumer protection authority or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' advance notice of material changes by email or by prominently posting notice within the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
